11/19/2015 - Men arrested after claiming they were assaulted by an Off-Duty Deputy

On November 4, 2015, Chief Deputy William Parris was made aware of a complaint against one of our investigators while he was working off duty security at The Beacon Restaurant. The alleged victim, Danny O’Neal Miller, Sr. , claimed our investigator assaulted him. Miller also stated his wife and another witness, Donald Carl Fowler, witnessed the incident. Investigative supervisors took written and sworn statements from all 3 parties, who claimed the incident occurred approx. 4 weeks ago. As the investigation progressed, it was discovered the incident actually occurred in July, 2015. A surveillance video from The Beacon was retrieved and reviewed, which exonerated our investigator. After consultation with the Solicitor’s Office, Chief Parris presented the findings of his investigation to a magistrate who issued a warrant on Miller for False Information to Police, and a warrant on Fowler for Obstruction of Justice.  Both were arrested earlier today and currently are incarcerated in the detention facility. The decision was made not to charge Miller’s wife, since she was only reporting what her husband told her. She didn’t witness the incident, since she was in a vehicle at the time. Miller had originally come into the restaurant to pick up an order of food. Our investigator was not at the register at that time. After taking the food outside to his vehicle, Miller’s wife wanted some more tartar sauce for the fish he had purchased. Miller came back inside, asked for the condiment, and it was placed in a bag for him to carry out. As Miller was leaving the restaurant the second time, our investigator was back at the register. He saw Miller bypassing several other patrons in line with a bag in his hand and asked him if he had paid for his order, to which Miller took exception.
